By using the website assessment services provided by Red Kite Creative LLC (“we,” “us,” or “our”), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. Services Offered
Red Kite Creative LLC offers free and paid website assessments to help clients evaluate and improve their online presence. The nature and scope of the assessments will be outlined in the service agreement between Red Kite Creative and the client.
The paid website assessment requires that Red Kite Creative LLC install a plugin on your website temporarily. Instructions will be provided. If access is not granted, the assessment will not be completed.
3. Payment and Fees
If you opt for a paid website assessment, you agree to pay the specified fees as outlined in the signup form or service agreement. Payments must be made in accordance with the agreed-upon terms.
When initiating a purchase on this website, your payment will be processed through a third-party payment processor, Stripe. Stripe will be responsible for the collection of your payment information and the processing of your payment. Please be advised that we do not assume responsibility for the collection, use, sharing, or security of your billing information by Stripe. The third-party payment processor accepts the following payment methods: American Express, Discover, MasterCard, and Visa.
By making a purchase, you affirm and warrant that you possess the legal right to use the designated payment method(s) for the transaction. Additionally, you confirm that the information provided to both Red Kite Creative LLC and the third-party payment processor is accurate, true, and complete.
4. Intellectual Property
All content and materials provided as part of the website assessment services, including but not limited to reports, recommendations, and designs, are the intellectual property of Red Kite Creative LLC unless otherwise specified in writing. Clients are granted a non-exclusive, non-transferable license to use these materials solely for their intended purpose.
5. Confidentiality
Both parties agree to keep any confidential information shared during the website assessment process confidential. This includes, but is not limited to, proprietary business information, trade secrets, and any other non-public information.
6. Limitation of Liability
To the fullest extent permitted by law, Red Kite Creative LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
7. Cancellation
We offer cancellations only prior to performance of the assessment service and a refund will be provided. The client acknowledges and agrees that no refunds will be provided if the assessment has already been conducted.
8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Colorado, United States.
9. Changes to Terms
Red Kite Creative LLC reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. It is your responsibility to review these terms periodically.
